CHARLES TOWN, W.Va — After nearly four hours of deliberation between counsel for Sidewinder Enterprises, the Jefferson County Planning Commission (JCPC) and the intervenors in support of JCPC in Jefferson County Circuit Court, Judge Bridget Cohee handed Sidewinder yet another loss in its continuing fight to construct a water bottling facility and pipeline in historic Middleway, siding with JCPC and the intervenors.
“We’re grateful for the outcome today and the thoughtfulness and care the court showed the intervenors and this case,” said Dr. Christine Wimer, President of Jefferson County Foundation, Inc. “We appreciate the efforts that the Planning Commission made to listen to the community and defend their decision. The other intervenors are relieved their thoughts on this matter were heard and we appreciate the bravery they showed in standing up for their community’s well-being.”
When rendering her decision, Cohee agreed that the planning commission “acted appropriately” and that its decision to reject the Mountain Pure concept plan should be upheld. Cohee also agreed that the planning commission has the authority to deny projects at the concept plan stage, and that the Mountain Pure plan did not meet requirements in the county’s zoning ordinance.
